Terms of Service
The ground rules for working with Krush It, covering how projects, payment, ownership and hosting work.
01About these terms
These terms apply to your use of krush.it.com and to the services Krush It provides to you ("Services"). By using our website, paying a deposit or signing a quote, you agree to them. If you do not agree, please do not use our Services.
Krush It is a marketing agency based in Vancouver, British Columbia. In these terms, "you" means the person or business buying or using our Services.
02Our Services
We offer website design, logo design, brand design and social media content creation, along with website hosting. Our packages and what each one includes are described on our website at the time you order.
The quote, invoice or proposal we send you (your "Order") sets out the scope, price and timeline for your project. If your Order and these terms conflict, your Order applies to that project.
03Prices, taxes and payment
- Prices are in Canadian dollars. GST, and PST where it applies, is added.
- Most projects start with a 50% deposit. We begin work once we have received the deposit and your intake form.
- The balance is due before your website goes live or your files are delivered, unless your Order says otherwise.
- Payments are processed by Stripe. Hosting and other recurring fees are charged to the payment method you give us.
- If a payment is late, we may pause work until it is paid.
04Timelines and revisions
- Our turnaround times, such as 5 business days for Launch, 10 for Growth and 15 for Signature, start once we have your deposit, your intake form and the materials we need.
- Your package includes a set number of revision rounds: one for Launch, two for Growth and three for Signature. A round is one consolidated set of changes.
- Extra rounds, new pages and changes to the agreed scope are quoted at a fixed price before we start them.
- If you are slow to give feedback or materials, your delivery date moves by the same amount.
05Your responsibilities
- Give us accurate, complete materials, and respond to requests and approvals in good time.
- Make sure you own, or have permission to use, everything you give us, including logos, photos, text, music and reviews.
- Make sure the claims you ask us to publish about your business are true and lawful.
- Do not use our Services for anything illegal, misleading, harmful or infringing.
06Ownership and licences
- Your deliverables. Once you have paid in full, you own the final website content, logo, brand files and source files we create specifically for you.
- Our tools. We keep ownership of our pre-existing tools, templates, code and systems. We give you a licence to use them as part of your website for as long as you use it.
- Third-party assets. Fonts, stock images, icons and software we use stay under their own licences, which we will tell you about when they affect you.
- Your materials. You give us permission to use the materials you supply for the purpose of delivering your project.
- Portfolio. We may show your finished work in our portfolio and marketing. Tell us in writing if you would prefer we did not.
07AI-assisted production
We use AI tools alongside our designers to work quickly. A person at Krush It reviews what we deliver. We take care to keep your materials confidential when we use these tools. You are responsible for reviewing the final work before you approve it. Some AI-generated material may have limited copyright protection under the law.
08Website hosting
- Hosting costs $59 per month. It covers hosting on our servers, SSL, a content delivery network, nightly backups kept for 30 days, uptime monitoring, security patches and small text or image edits.
- The first 3 months of hosting are included with Launch and Growth, and the first 6 months with Signature. After that, hosting renews monthly.
- Hosting is month to month. You can cancel any time from your billing portal. Cancellation takes effect at the end of the billing period you have paid for.
- If a hosting payment fails and is not fixed within 14 days of our notice, we may suspend your website. We delete a cancelled or suspended website 30 days later unless you ask for an export first.
- If you leave, we give you a deployable copy of your website for a flat $250 export fee.
- We work to keep your website available, but we cannot guarantee it will never be interrupted.
09Social media content
We create content for your approval and, if you ask, schedule it to your accounts using the access you give us. You keep ownership of your accounts. Platforms set their own rules and can change or remove content or accounts, and we are not responsible for those decisions. We cannot promise any number of views, followers, clicks or leads.
10Refunds
You will see a live preview before anything goes public. If you are not satisfied at that review stage and have not yet approved the design for launch, we refund your deposit.
After you approve the design, launch the website or receive final files, fees already paid are not refundable, except where the law requires it or where we have not delivered what your Order promised. Hosting fees are not refunded for part of a month.
11Founders' pricing
Our first ten clients receive founders' pricing, shown on our website, on the packages they order. Founders' prices on services you have already ordered do not change. We may change prices for new clients at any time.
12Confidentiality
Each of us will keep the other's non-public business information confidential and use it only for the project. This does not apply to information that is already public, that you or we learned from someone else without restriction, or that we must disclose by law.
13What we promise, and what we don't
We provide our Services with reasonable skill and care. We do not promise any particular result, such as search rankings, website traffic, leads or sales, because these depend on many things outside our control. Except where the law says otherwise, our Services are provided "as is", without other warranties or conditions.
14Limits on our liability
To the fullest extent the law allows, Krush It is not liable for indirect or consequential losses, or for lost profits, revenue, data or opportunities. Our total liability for any claim relating to a Service is limited to the amount you paid us for that Service in the 12 months before the claim arose. Nothing in these terms limits liability that cannot be limited by law.
You agree to cover claims and costs that arise from materials you supply or from your use of our Services in breach of these terms.
15Ending our relationship
You can end a project or hosting at any time by telling us in writing. We can stop work or end the Services if you do not pay, break these terms or ask us to do something unlawful. Fees for work already done remain payable, and the sections on ownership, payment, confidentiality, liability and governing law continue after the Services end.
16Messages and notices
You agree that we can send you service messages and notices by email. We send marketing messages only with your consent, and you can withdraw it at any time. Send notices to us at hello@krush.it.com.
17Changes to these terms
We may update these terms from time to time. The date at the top shows when they last changed. Changes do not affect an Order you have already accepted, unless the law requires them to.
18Governing law
These terms are governed by the laws of British Columbia and the federal laws of Canada that apply there. We will try to resolve any dispute with you informally first. If we cannot, the courts of British Columbia have jurisdiction.
